AnDphotos Royalty Free Image License Agreement

By downloading or purchasing any image, you agree to and will abide by the terms and conditions herein. If you are downloading or purchasing an image on behalf of your employer, than your employer is also bound by the terms of this agreement.

AnDphotos is wholly owned and operated by Alan and Dolly Graham and holds copyright for all images, website content and digital media. No title, ownership, or intellectual property rights are transferred to you or your company upon purchase or download. AnDphotos retains all rights in this material. This agreement covers all copyrighted material.

In your use of these images it must be clear that these are copyrighted works and may not be copied or reproduced in any way.

AnDphotos gives you the non-exclusive right to use the downloaded image for the stated purpose below only.

Preview and thumbnail images may be downloaded to use as comps only. No publication or presentation is permitted in any media.

Free desktop images may be downloaded and used as a private desktop display only. No other use is permitted in any media.

Purchased images - The image may be incorporated into or used in the following: broadcasting, advertising, multimedia, film or video productions, in live performances, internet displays, business presentations and brochures, editorial publications, books, newspaper formats or commercial print runs such as postcards, posters, badges or calendars.

Restrictions:

This licence is granted for a period of 5 years from the date of purchase.

These images may not be used in templates or applications which allow other users to create multiple versions of a printed or electronic product.

These images may not be displayed for sale in any photo library or gallery.

These images may not be leased, hired, rented, lent, transmitted, sold or sublicensed to another company, to other persons outside your company or business or to other entities. Agents purchasing on behalf of a client must purchase in the name of the client and both the agent and the client must abide by the terms of this agreement.

These images may not be incorporated in or used with defamatory, obscene, pornographic, fraudulent, libelous, immoral or illegal material.

You may not use these images in any way that would restrict the legal use of any image by anybody else, i.e. trademarks.

You may not use any image in any way other than that expressed in this agreement.

AnDphotos warrants these images to be free from defects in material and workmanship for 30 days from purchase. Your sole and exclusive remedy for a breach of this warranty is a refund of the purchase price. No other warranty is made or implied under this Agreement.

Under no circumstances will AnDphotos be responsible to you for more than the purchase price.

AnDphotos will not be liable to you for any special, indirect, consequential, punitive, or incidental damages (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use any image.

All license rights granted pursuant to this Agreement shall automatically terminate upon your breach of this Agreement.

If any part of this Agreement is found void or unenforceable, it will not affect the validity of the remainder of the agreement, which shall continue to be valid and be enforceable according to its terms.
